In India, an employer must pay monthly wages before the expiry of the 7th day of the following month, and must clear a leaver's wages within two working days of resignation, removal or retrenchment. This comes from Section 17 of the Code on Wages, 2019, which applies to employees at every salary level. If your contract promises an earlier date, the earlier date is the one that matters.
General information based on the statute text and published guidance, not legal advice. Last reviewed September 30, 2026.
Most confusion about late salary comes from four terms being used as if they meant the same thing. Knowing the difference tells you which date to measure a delay against.
A gap of a day or two between payday and credit date is usually the bank's processing time. A delay past the statutory deadline is a compliance failure, whatever the reason.
The Code on Wages, 2019 consolidated four older laws, including the Payment of Wages Act, 1936, and came into force on 21 November 2025. Section 17 sets the time limits for paying wages. Two changes matter most for employees. The rules apply irrespective of salary, whereas the old Act covered only employees below a wage ceiling, and the monthly deadline moved from the 10th to the 7th.
| Wage basis | Employer must pay |
|---|---|
| Daily | At the end of the shift |
| Weekly | On the last working day of the week, before the weekly holiday |
| Fortnightly | Before the end of the second day after the fortnight ends |
| Monthly | Before the expiry of the 7th day of the succeeding month |
| Resignation, removal, dismissal, retrenchment, closure | Within two working days |
A note on "two working days": the statute says within two working days of removal or resignation. Practitioners read this slightly differently when there is a notice period (from the date of resignation versus the last working day). Do not assume you can wait out the notice period. Ask HR in writing which date they are counting from.
Not every payment you are owed follows the 7th-day rule. Check which bucket a payment belongs to before calling it late.
Always request the settlement in an itemised form. It makes gaps visible, and it gives you a document to cite if you escalate.
Many candidates placed by Voltech HR Services work in the Gulf, where salary is monitored electronically rather than left to the contract alone. In the UAE, private-sector employers registered with MOHRE must pay salary through the Wage Protection System (WPS), which gives the ministry a record of every transfer.
What to do: if you work in the UAE and your salary is overdue, confirm your due date in your contract, keep your payslips and bank statements, and contact MOHRE through its official channels (the 80060 line, the MOHRE app or mohre.gov.ae). Because the enforcement rules have been changing, treat the current MOHRE page as the final word, not any blog, including this one.
United Kingdom: there is no statutory payday. The date in your contract governs, and section 13 of the Employment Rights Act 1996 makes unauthorised deductions from wages unlawful. Unpaid contractual pay can be pursued at an employment tribunal after Acas early conciliation, generally within three months less one day of the payment date. Time limits are subject to reform, so confirm the current limit with Acas.
United States: the Fair Labor Standards Act requires payment of earned wages on the regular payday but sets no federal deadline for final paychecks. State wage-payment laws fill the gap, and the rules differ widely. Some states require final pay immediately on termination, others by the next regular payday. Check your state labor department.
| Country | Monthly pay rule | Exit dues | Where to complain |
|---|---|---|---|
| India | Before the end of the 7th of the next month (Code on Wages, s.17) | Two working days | Labour authority / Inspector-cum-Facilitator of your state |
| UAE (mainland) | Through WPS; generally late after 15 days, enforcement tightening | Generally within 14 days | MOHRE |
| UK | As per contract; no fixed statutory day | As per contract | Acas, then employment tribunal |
| USA | Regular payday; state law applies | Varies by state | State labor agency or US Department of Labor |
Understanding the cause helps you ask HR the right question and helps you decide whether the delay is a one-off or a warning sign.
Subject: Salary for [month] not yet credited
Dear [HR name],
My salary for [month], due on [payday as per contract], has not been credited to my account as of [today's date]. Could you please confirm the reason for the delay and the date by which it will be paid?
Under Section 17 of the Code on Wages, 2019, monthly wages are payable before the expiry of the 7th day of the following month. Please treat this as a request to resolve the matter at the earliest.
Regards,
[Name, employee ID]
Late salary damages trust, invites penalties and raises attrition. A basic payroll calendar prevents most delays.
Employers who prefer to outsource this can use our Staffing & Payroll Services which cover payroll processing, statutory compliance and payslip management.
For monthly-paid employees, before the expiry of the 7th day of the next month under Section 17 of the Code on Wages, 2019, unless your contract or another applicable law gives an earlier date.
Wages payable on resignation, removal, dismissal or retrenchment must be paid within two working days. Gratuity follows its own separate process.
Section 54 provides a fine of up to ₹50,000 for paying less than what is due, with stricter penalties for repeat offences within five years.
The limitation period for worker claims under the Code is three years, but raising the issue in writing quickly gives you a stronger record.
Bank credit can shift to the next working day, but the statutory deadline does not move. Employers should run payroll early when the 7th falls on a holiday.
Only in line with your contract and the deduction rules of the law. Withholding earned wages without a lawful basis can be challenged.
The Code's payment-of-wages provisions apply irrespective of salary, so they are not limited to low-wage workers. Check your state's rules and the central rules for any sector-specific variation.
Historically after 15 days from the due date under WPS, but MOHRE's enforcement has been tightening, so confirm the current position with MOHRE.
